Welcome to Omstep. The terms “we,” “us,” and “our” refer to Omstep LLC. Omstep LLC operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Omstep LLC is powered by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is accurate, current, and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all activity associated with your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made reasonable efforts to provide an accurate representation of our products and services. Colors and product appearance may differ from how they appear on your screen due to your device and settings.
We do not warrant that the appearance or quality of any products purchased by you will meet your expectations or be identical to products depicted in our store.
All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities we offer to any person or jurisdiction.
Omstep footwear is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. Conductivity depends on surface and conditions. Results vary. No specific health or performance outcome is guaranteed. See our Disclaimer.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Omstep LLC reserves the right to accept or decline your order for any reason permitted by law. Your order is not accepted until Omstep LLC confirms acceptance. We must receive and process your payment before your order is accepted.
Cancellations and returns are governed by our Refund Policy.
If you place a preorder, payment is collected at checkout. Ship dates are estimates only. You may cancel a preorder for a full refund by emailing support@omstep.com before the order ships. After the order ships, the Refund Policy applies. The 30-day return window starts when the item is received, not when you prepaid. If we cannot fulfill a preorder, we will refund the amount you paid.
If we do not accept, change, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number provided at checkout.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless expressly stated, posted prices do not include applicable taxes, shipping, handling, customs, or import charges.
We may offer promotions from time to time that are governed by separate terms. If those terms conflict with these Terms, the promotion terms govern.
You agree to provide current, complete, and accurate purchase, payment, and account information and to update that information as needed.
You represent and warrant that: (a) the payment information you provide is true, correct, and complete; (b) you are authorized to use that payment method; (c) charges will be honored by your payment provider; and (d) you will pay all charges incurred at the posted prices, including shipping, handling, and applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather, or other events outside our reasonable control.
Shipping, delivery, lost packages, and damage in transit are handled as described in our Shipping Policy and Refund Policy.
Risk of loss passes to you when the carrier marks the order delivered, except for confirmed damage in transit handled under the Refund Policy.
SECTION 6 - INTELLECTUAL PROPERTY
The Services, including trademarks, text, images, graphics, video, audio, and design, are owned by Omstep LLC or its licensors and are protected by intellectual property laws.
These Terms permit personal, non-commercial use only. You must not copy, distribute, modify, or create derivative works from material on the Services without our prior written consent, except as permitted by law.
Nothing in these Terms grants you a license under any intellectual property of Omstep LLC, Shopify, or any third party except as expressly stated. All rights not expressly granted are reserved by Omstep LLC.
Omstep LLC names, logos, product names, designs, and slogans are trademarks of Omstep LLC or its licensors. You must not use them without prior written permission. Shopify marks belong to Shopify. All other marks on the Services belong to their owners.
SECTION 7 - OPTIONAL TOOLS
You may be given access to third-party tools. We do not monitor or control those tools. They are provided “as is” and “as available,” without endorsement. Use is at your own risk. Review the third party’s terms before use.
New features we add are part of the Services and are subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links or embedded tools operated by third parties. We are not responsible for their content, accuracy, or practices. If you leave the Services, you do so at your own risk. Questions about third-party products or services should be directed to that third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Omstep LLC is powered by Shopify. Sales and purchases in our store are made directly with Omstep LLC.
Shopify is not responsible for sales between you and Omstep LLC, including injury, damage, or loss from products purchased from Omstep LLC. To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from your purchases and transactions with Omstep LLC.
SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy, which is part of these Terms and is posted on our website.
Certain information may also be subject to Shopify’s privacy terms at https://privacy.shopify.com/en.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services. Information you submit may be transmitted to Shopify and other providers, including in other countries, to operate the store.
SECTION 11 - FEEDBACK
If you submit ideas, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for any lawful purpose, including commercial use.
You represent that you have the rights to the Feedback, you have disclosed any compensation tied to it, and it complies with these Terms. We have no duty to keep Feedback confidential, pay for it, or respond to it.
We may remove Feedback we find unlawful, offensive, or in violation of these Terms. You are solely responsible for Feedback you submit.
SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS
The Services may contain errors relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct that information and cancel or change orders if information is inaccurate, including after you submit an order, to the extent permitted by law.
SECTION 13 - PROHIBITED USES
Use the Services only for lawful purposes. You may not use the Services to violate law, infringe intellectual property, harass others, send spam, impersonate anyone, spread malware, scrape or attack the site, or collect others’ personal information without authorization.
We may suspend or terminate access if we determine you have violated these Terms or applicable law.
SECTION 14 - AUTOMATED ACCESS AND AGENTS
Software or services that automatically access the Services on your behalf (“Agents”) must follow these Terms. Agents must not pretend to be human, bypass CAPTCHAs or security controls, hide that they are automated, or keep accessing the Services after we ask them to stop. We may block automated access.
SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services, subject to applicable law. You remain responsible for amounts due through the termination date.
These sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other section that by its nature should survive.
SECTION 16 - DISCLAIMER OF WARRANTIES
Information on the Services is for general information only. We do not warrant that it is accurate, complete, or useful. Reliance on that information is at your own risk.
EXCEPT AS EXPRESSLY STATED BY OMSTEP LLC, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT THESE DISCLAIMERS.
SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OMSTEP LLC AND ITS OWNERS, EMPLOYEES, AND SERVICE PROVIDERS, AND SHOPIFY AND ITS AFFILIATES, ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, ARISING FROM THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS.
SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless Omstep LLC and Shopify, and our and their officers, employees, and service providers, from third-party claims arising out of your breach of these Terms, your violation of law or third-party rights, or your use of the Services, including reasonable attorneys’ fees, to the extent permitted by law.
SECTION 19 - SEVERABILITY
If any provision of these Terms is unenforceable, the remaining provisions remain in effect.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Failure to enforce a provision is not a waiver. These Terms and the policies posted on the site are the entire agreement between you and Omstep LLC regarding the Services.
SECTION 21 - ASSIGNMENT
You may not assign these Terms without our prior written consent. We may assign these Terms without notice.
SECTION 22 - GOVERNING LAW
These Terms of Service are governed by the laws of the State of Missouri. You and Omstep LLC consent to venue and personal jurisdiction in the state and federal courts located in Missouri.

SECTION 24 - CHANGES TO TERMS OF SERVICE
We may update these Terms by posting the revised version on this page. Material changes will be noticed as required by law. Continued use of the Services after changes are posted is acceptance of the updated Terms.
